By accessing or using the NZ-Safety website and registering for any of our services, you acknowledge and agree to the following terms and conditions. Please read them carefully. NZ-Safety LLC (“NZ-Safety,” “we,” “us,” or “our”) is the dedicated training division of Zack’s Sports Inc., located in Round Lake, New York.

TRAINING SERVICES

NZ-Safety provides professional firearm training courses, less-lethal (Byrna) orientation, concealed carry permit classes, and related educational services. Our course offerings include but are not limited to: Handgun Fundamentals, NY 18-Hour Handgun Safety Course, Byrna Orientation, and Utah Concealed Carry Permit (CFP) classes.

All training activities involve inherent risks associated with firearm and less-lethal device use. By registering for and participating in any NZ-Safety course, you acknowledge and voluntarily accept these risks. A separate Training Waiver and Release of Liability must be signed prior to participation in any live-fire or hands-on training.

ELIGIBILITY & COMPLIANCE

You must be at least 18 years of age to register for courses independently. Participants under 18 may attend certain courses only with written parental or legal guardian consent and must be accompanied by a registered adult. NZ-Safety reserves the right to verify age and eligibility at any time.

For courses involving live firearms, participants must not be prohibited from possessing firearms under federal, state, or local law. It is your responsibility to ensure you are legally permitted to handle firearms before registering for any live-fire course. All firearm-related activities must comply with New York State Penal Law and any applicable local laws. We reserve the right to refuse service to any individual who does not meet legal eligibility requirements.

REGISTRATION & PAYMENT

Course registration requires full payment at the time of booking unless otherwise stated. All prices are listed in U.S. dollars (USD) and are subject to change without notice. We accept major credit and debit cards through our secure, PCI-compliant payment processor.

Registration is confirmed only upon receipt of full payment and a confirmation email from NZ-Safety. A registration does not guarantee a seat until payment is processed successfully. The Credit Card Billing Information is sent directly to our payment provider who processes your credit card transaction. The credit card information is neither recorded nor stored by us, and it can only be accessed by our payment provider.

CANCELLATIONS, REFUNDS & RESCHEDULING

If you are not satisfied with your registration or need to change your plans, the following policies apply:

48+ hours before class: Free rescheduling to any available future date.
Within 48 hours of class: No refund. You may reschedule one time to a future date at no additional charge, subject to availability.
No-shows: Forfeit the full course fee with no refund or rescheduling.

NZ-Safety Cancellations: We reserve the right to cancel or reschedule any course due to weather, instructor availability, facility issues, or insufficient enrollment. In such cases, you will receive a full refund or the option to reschedule at no cost.

Refunds will not be issued for: Change of mind after the 48-hour window has passed, failure to attend without prior notification (no-shows), or removal from a course due to safety violations or code of conduct breaches.

CODE OF CONDUCT

All participants are expected to:

Follow all instructor directions and range commands at all times
Adhere to the four fundamental rules of firearm safety
Treat all students, staff, and facilities with respect
Arrive on time and prepared for the scheduled course
Refrain from the use of alcohol or controlled substances before or during training

NZ-Safety reserves the right to remove any participant from a course — without refund — for unsafe behavior, intoxication, disruptive conduct, or failure to follow safety protocols. The decision of the lead instructor is final.

ASSUMPTION OF RISK & LIABILITY

Firearm training and related activities carry inherent risks, including but not limited to hearing damage, physical injury, and exposure to lead or other materials. By participating in any NZ-Safety course, you acknowledge these risks and agree that NZ-Safety LLC, its owners, employees, instructors, and affiliates (including Zack’s Sports Inc.) shall not be held liable for any injury, loss, or damage arising from your participation, except in cases of gross negligence or willful misconduct on the part of NZ-Safety.

It is your responsibility to ensure that you meet all legal requirements to participate in training courses. We are not liable for any issues or legal consequences arising from the failure to comply with state or federal laws regarding firearm ownership, possession, or use.

CERTIFICATES OF COMPLETION

Certificates of completion are issued only to participants who attend the full course duration and successfully meet all requirements (including any written exams and/or shooting qualifications where applicable). NZ-Safety reserves the right to withhold a certificate from any participant who does not meet the minimum standards or who demonstrates unsafe behavior.

A certificate of completion does not guarantee the issuance of any permit or license. Permit applications are processed by the relevant county or state authority and are subject to their own requirements and approval processes.

PHOTOGRAPHY & MEDIA

NZ-Safety may take photographs or video during training sessions for use on our website, social media, or marketing materials. By participating in a course, you grant NZ-Safety a non-exclusive, royalty-free right to use your likeness in such materials. If you do not wish to be photographed, please notify your instructor before the course begins.

ONLINE PRICE & DESCRIPTION ERRORS

All items on this website are subject to change without notice. This includes course availability, scheduling, and pricing. Occasionally a course may appear on the site by mistake or the description may contain a typographical error. We do not guarantee that titles, descriptions, pictures, or prices on our site are error-free. We reserve the right to refuse any order, including but not limited to orders for items with errors in the description or price.

In the event that we cancel an order, we will not charge the customer’s credit card, or we will issue a full refund. If a course description contains an error such as incorrect pricing and a customer places an order, we will not process the order without first contacting the customer. By placing an order, the customer agrees that NZ-Safety will be the final arbiter of any discrepancies.

INTELLECTUAL PROPERTY

All content on the NZ-Safety website — including text, graphics, logos, images, and course materials — is the property of NZ-Safety LLC or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without prior written consent from NZ-Safety.

DISCLAIMER OF WARRANTIES

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. NZ-Safety does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Course content and schedules are subject to change without notice.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, NZ-Safety LLC, its owners, officers, employees, instructors, and affiliates (including Zack’s Sports Inc.) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or participation in our courses. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the specific course or service giving rise to the claim.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NZ-Safety LLC, its owners, officers, employees, instructors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Saratoga County, New York. You consent to the personal jurisdiction of such courts.

CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Changes become effective immediately upon posting to this page. The “Last updated” date at the top will reflect the most recent revision. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
